The evidence
What an oncology expert witness is asked to determine
The central question in most oncology claims is what difference timing made. That requires the expert to address stage at the notional earlier date, the treatment that would then have been available, and the effect on survival or morbidity, each within the limits of the evidence.
- Whether the presenting symptoms warranted urgent referral under the pathway in force.
- What stage the disease had probably reached at the date the diagnosis should have been made.
- Whether the treatment given, including regimen and dose, met the expected standard.
- Whether toxicity and complications were recognised and managed appropriately.
- What can properly be said about the effect of delay on treatment options and outcome.
