Terms of Use
The terms on which you may use the ExpertSearch website. ExpertSearch is a directory that helps referring solicitors and barristers find medical expert witnesses across England, Wales, Scotland and Northern Ireland. Please read these terms carefully before using the site.
ExpertSearch lists medical expert witnesses so that referring solicitors and barristers can find and contact them. We provide the directory itself. We do not appoint experts on your behalf, give legal or medical advice, or guarantee the suitability of any expert for a particular case. Responsibility for assessing and engaging an expert rests with the referring party.
1About these terms
These terms of use govern your access to and use of the ExpertSearch website at expertsearch.co.uk. By using the site you agree to these terms. If you do not agree, please do not use the site.
The site is operated by ExpertSearch (“we”, “us”, “our”). We may refer in these terms to “you” as the person using the site, whether a referring solicitor, barrister, listed expert or other visitor.
2About ExpertSearch
ExpertSearch is an online directory of medical expert witnesses. Its purpose is to help referring solicitors and barristers identify experts by specialty and by region across the four UK nations, and to make contact with them.
We provide the directory and the means to make an enquiry. We are not a party to any agreement reached between a referring party and an expert. We do not act as an agent for either party, and we do not supervise, manage or take part in any expert engagement that follows.
3Using the website
You agree to use the site lawfully and in line with these terms. In particular, you agree not to:
- use the site or its content for any unlawful, fraudulent or harmful purpose;
- collect, scrape or harvest contact details or other data from the directory by automated means;
- use directory contacts to send unsolicited marketing or bulk communications;
- attempt to gain unauthorised access to the site, its servers or connected systems;
- introduce malicious code, or otherwise disrupt or interfere with the site;
- copy, republish or exploit the directory or its content except as permitted in these terms.
We may suspend or withdraw access to the site, in whole or in part, where we reasonably consider that these terms have been breached.
4Listings and enquiries
Information about listed experts is provided by the experts themselves or compiled from sources believed to be reliable. While we take reasonable care, we do not verify or guarantee every detail, and listings may change.
- Due diligence. Referring parties remain responsible for assessing an expert’s suitability, qualifications, registration and availability before engaging them.
- No endorsement. A listing does not amount to a recommendation or endorsement by us of any expert.
- Expert duties. Any expert appointed in litigation owes their duties to the court, including the duties set out in Part 35 of the Civil Procedure Rules in England and Wales, and the equivalent rules applying in Scotland and Northern Ireland. Those duties rest with the expert and are not affected by their listing in the directory.
- Accuracy of listings. Listed experts are responsible for the accuracy of the details they provide and for keeping them up to date.
Nothing on this site forms a retainer or contract between you and any expert. Terms of engagement, fees and scope are matters to be agreed directly between the referring party and the expert.
5Intellectual property
The site, its design, text, graphics and the arrangement of the directory are owned by us or our licensors and are protected by intellectual property laws. You may view and print pages for your own professional reference. You may not otherwise copy, reproduce, distribute or commercially exploit any part of the site without our prior written permission.
6Disclaimers
The site is provided for general information and to help referring parties find experts. It does not provide legal, medical or other professional advice, and it should not be relied on as such.
We provide the site on a reasonable-efforts basis. We do not warrant that it will be uninterrupted, error free or free of harmful components, or that the directory information is complete, current or accurate at all times.
7Limitation of liability
Nothing in these terms limits or excludes our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or for fraud.
Subject to that, we are not liable for any loss or damage arising from your use of, or inability to use, the site, or from your reliance on any directory content. This includes, to the extent permitted by law, any loss of profit, loss of business, or any indirect or consequential loss.
We are not responsible for the acts, omissions, advice or reports of any expert listed on the site. Any matter arising from an expert engagement is between the referring party and the expert.
8Links to other sites
The site may contain links to external websites, including the websites of listed experts. We provide these for convenience only and have no control over their content. A link does not imply endorsement, and we are not responsible for external sites.
9Privacy and cookies
Our handling of personal data is explained in our Privacy Policy, and our use of cookies is explained in our Cookie Policy. By using the site you acknowledge those policies.
10Changes to the site and these terms
We may update the site and these terms from time to time. The version that applies is the one published here when you use the site. We will revise the “Last updated” date when we make changes. Please review these terms periodically.
11Governing law and jurisdiction
These terms and any dispute arising from them are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction. Where you are resident in Scotland or Northern Ireland, you may also be entitled to bring proceedings in your local courts.
