Listed infertility expert witnesses address investigation of subfertility, assisted conception and the handling of gametes and embryos. The regulatory framework governing licensed treatment is often central to the instruction.

The evidence

What an infertility expert witness is asked to determine

Fertility claims may concern investigation and diagnosis, the conduct of a treatment cycle, consent, or the storage and handling of material. Clinic records, consent documentation and laboratory records each answer a different part of the question. Age, ovarian reserve and the number of cycles already undertaken all affect what can properly be said about the prospects lost, and each should be addressed on the evidence.

  • Whether investigation of subfertility was appropriate to the history recorded.
  • Whether the treatment offered and the counselling given reflected the prospects documented.
  • Whether consent was obtained and recorded in the form the treatment required.
  • Whether ovarian hyperstimulation or another recognised complication was anticipated and managed.
  • Whether laboratory handling, identification and storage followed the standards in place.

Practitioners are listed across all four UK nations. Location can be narrowed in the register’s location listings before an instruction is made.

Report routes

Reports prepared

Clinic, consent and laboratory records support a records review report. A breach and causation report then addresses the loss alleged.

Where the regulatory question is separate from the clinical one, both may need to be addressed. The report pages state what each of those routes covers.

Infertility expert witness evidence

A fertility expert witness separates the clinical question from the regulatory and laboratory questions, and answers each from its own record.

The listing shows discipline and location; conflicts and terms are addressed directly. See the Human Fertilisation and Embryology Authority alongside the case material.
