What an infertility expert witness is asked to determine
Fertility claims may concern investigation and diagnosis, the conduct of a treatment cycle, consent, or the storage and handling of material. Clinic records, consent documentation and laboratory records each answer a different part of the question. Age, ovarian reserve and the number of cycles already undertaken all affect what can properly be said about the prospects lost, and each should be addressed on the evidence.
- Whether investigation of subfertility was appropriate to the history recorded.
- Whether the treatment offered and the counselling given reflected the prospects documented.
- Whether consent was obtained and recorded in the form the treatment required.
- Whether ovarian hyperstimulation or another recognised complication was anticipated and managed.
- Whether laboratory handling, identification and storage followed the standards in place.
