The legal context for expert evidence
The procedural framework depends on the court and the type of proceedings. CPR Part 35 is not the governing rule in the Republic of Ireland.
For the proceedings to which Order 39, rules 56 to 61 of the Rules of the Superior Courts apply, an expert’s duty is to assist the Court on matters within their expertise. That duty overrides any obligation to the party paying the expert’s fee.
An expert report delivered under those rules must acknowledge that duty and disclose the relevant financial or economic interests described in the rules. Instructing solicitors should confirm the applicable forum, directions and report requirements for the case before instruction.

Criminal and coronial procedure
Criminal evidence and inquests in the Republic of Ireland
Criminal jurisdiction is organised differently from the civil rules above. The District Court deals with summary offences and the initial hearings of serious matters; the Circuit Court tries most indictable offences before a judge and jury. The Central Criminal Court is the High Court exercising criminal jurisdiction and tries cases outside the Circuit Court’s jurisdiction, principally murder and rape. The Special Criminal Court sits with three judges and no jury in the circumstances prescribed for it.
The Criminal Law (Insanity) Act 2006 uses the term fitness to be tried. Where the question arises in a criminal case, section 4 provides for medical evidence and the relevant court to determine the issue. It is not the England and Wales terminology of fitness to plead.
Coroners and inquests are governed by the Coroners Act 1962, as amended. The Act provides for coroner districts and sets the general duty to hold an inquest, with separate provisions for adjournment where criminal proceedings are being considered or have begun.
