Disability analysis expert witnesses

Listed disability analysis expert witnesses address the functional effect of a condition on everyday activity rather than its diagnosis or treatment. The question is what a person can reliably do, how often, and with what support.

The evidence

What a disability analysis expert witness is asked to determine

Disability analysis draws on clinical records, treatment history, reported activity and any formal assessment already carried out. The discipline is distinct from a treating clinician’s opinion, and the report should say which findings rest on documented evidence and which rest on account alone.

  • What the records show about mobility, self-care, communication and the reliability of each activity over time.
  • Whether reported limitation is consistent with the diagnosis, treatment history and observed function.
  • Whether variability, fatigue or fluctuation affects what can be said about repeated performance of a task.
  • What aids, adaptations or support the evidence indicates, and over what period.
  • Where a functional opinion ends and a treating specialty must address diagnosis, prognosis or capacity.

Practitioners are listed across all four UK nations. Location can be narrowed in the register’s location listings before an instruction is made.

Report routes

Reports prepared

Functional evidence commonly forms part of a care needs assessment, which addresses the support a person requires and over what period. Where present function and future course are both in issue, a condition and prognosis report may be instructed alongside it.

Statutory benefit assessments answer a different statutory test and are not interchangeable with evidence prepared for proceedings. What each report must contain is set out on its own page.

Disability analysis expert witness evidence

A disability analysis expert witness sets out functional capability against the documented clinical picture, and identifies the limits of what the available material can support.

The listing records the discipline and location; availability and terms are settled directly with the practitioner. See the UK Government assessment guidance alongside the case material.
