Listed advanced practice expert witnesses address care delivered by practitioners working at an extended level of clinical responsibility, including assessment, diagnosis, prescribing and discharge. The relevant question is the standard expected of that role, not of a doctor performing the same task.

What an advanced practice expert witness is asked to determine
Advanced clinical practitioners come from nursing, pharmacy, paramedic and allied health backgrounds, and their scope is set by employer governance, professional registration and the capability framework they were working to. An instruction should identify the role held, the supervision arrangements in place and the decision under scrutiny.
- What clinical scope the practitioner held at the relevant date, and what governance or supervision applied to it.
- Whether the assessment, diagnosis or treatment plan met the standard expected of a competent practitioner in that role.
- Whether escalation to a supervising clinician was indicated by the findings recorded.
- Whether prescribing, referral or discharge decisions fell within the practitioner’s scope and were adequately documented.
- Where the practitioner’s own registrant standards end and an employer governance question begins.

Reports prepared
Scope-of-practice questions are commonly answered from documents, and a records review report can address the consultation record, governance material and prescribing entries. A breach and causation report separates the standard expected of the role from the consequence alleged.
Where the instruction concerns a practitioner registered with a different regulator, the applicable standards should be identified in the report rather than assumed. The relevant report page sets out what the route requires.
