The legal context for expert evidence
The procedural framework depends on the court and the type of proceedings. CPR Part 35 is not the governing rule in the Republic of Ireland.
For the proceedings to which Order 39, rules 56 to 61 of the Rules of the Superior Courts apply, an expert’s duty is to assist the Court on matters within their expertise. That duty overrides any obligation to the party paying the expert’s fee.
An expert report delivered under those rules must acknowledge that duty and disclose the relevant financial or economic interests described in the rules. Instructing solicitors should confirm the applicable forum, directions and report requirements for the case before instruction.

Location context
Using the register in Ireland
Start with the field of evidence, then use location to narrow a clinically or technically suitable list. The register identifies practitioners; scope, availability, conflicts and the terms of instruction are agreed directly with the practitioner.
Remote report work may be suitable in some matters. Whether a particular instruction requires an in-person assessment, attendance at a hearing or a regulated professional registration is a matter to confirm before instruction.
